تقدم ستة وخمسون قاضيا أمس ببلاغ للنائب العام المستشار عبد المجيد محمود ضد المستشار ممدوح مرعي وزير العدل يتهمونه بإفساد القضاء والتأثير على استقلاله، والتدخل في بعض القضايا، مجاملة لمسئولين ووزراء سابقين، فضلا عن اتهامات باستغلال النفوذ والتربح من وظيفته.
جاء البلاغ الذي تقدم به "تيار الاستقلال" بنادي قضاة مصر، في أحدث حلقات الصراع مع وزير العدل، والذي يرجع إلى تعيينه في عام 2008، إبان سيطرة هذا التيار على النادي، حيث اتهمه القضاة مرارًا بإضعاف السلطة القضائية، والتأثير على استقلال القضاء لحساب السلطة التنفيذية.
وأدلى المستشاران هشام جنينة وأشرف زهران بأقوالهما أمام أحد المحامين العموميين بالمكتب الفني للنائب العام علي مدار ثلاث ساعات فى البلاغ الذي تقدما به نيابة عن ستة وخمسين قاضيًا.
واستند البلاغ إلى أقوال وتصريحات مساعد الوزير السابق لشئون الكسب غير المشروع أحمد الشلقاني، التي أكد فيها تدخل الوزير في قضايا الكسب غير المشروع، ومنعه من استكمال تحقيقات ومنعه من طلب إقرار الذمة المالية من بعض المسئولين ورجال الأعمال، وهو ما أدى إلى سقوط قضايا وضياع أموال على الدولة وإفلات المرتكبين من العقاب.
كما يتهمه البلاغ باستغلال نفوذه لمنع استكمال تحقيقات الرقابة الإدارية وإرسال تحقيقات متعلقة بإقرار ذمة مالية خاص بالمستشار طلعت حماد وزير شئون مجلس الوزراء السابق الذي كان منظورا فحص إقراره أمام المستشار أحمد مكي.
وتضمن البلاغ اتهامات لمرعي باستغلال نفوذه لصالح أبناء شقيقته، عبر محاولة إجبار أحد القضاة بمحكمة كفر الشيخ بإصدار حكم لصالحهم بتثبيت ملكيتهم لأكثر من اثني عشر فدانا مملوكين للإصلاح الزراعى دون وجه حق، وحينما رفض القاضي ذلك وقضى برفض الدعوى دبرت له قضية وتمت إحالته للجنة الصلاحية.
واتهم القضاة مرعي ومساعديه عبد السلام تمراز وعزت أبو الخير بتكوين جمعية استصلاح أراض بالبحيرة عام 1988، والحصول على أراض زراعية وصحراوية مقابل حفظ قضية أموال عامة، متهم فيها رئيس الهيئة الزراعية المصرية في ذلك الوقت، وقاموا بتقسم الأراضى على بعضهم وعلى أصدقائهم، وبيع جزء كبير منها لأفراد من خارج القضاء، وتربحهم من وراء هذا البيع.
كما تضمن البلاغ اتهامات للوزير بالاستيلاء على شقة مملوكة للأوقاف بمنطقة لوران بالإسكندرية باسم زوجته ونقل ملكيتها لها بالمخالفة للقانون، وكذلك استغلال المنح الواردة من الاتحاد الأوروبى لتعزيز استقلال القضاء ونشر الديمقراطية وتوزيعها كمكافآت عليه وعلى ومساعديه.
وأوضح المستشار أشرف زهران، أن هذه الاتهامات تستوجب إقالة الوزير من منصبه دون إحالته هو ومعاونيه للمحاكمة، لافتًا إلى وجود عدد من الشهود وردت أسماؤهم في البلاغ، ولديهم الرغبة للشهادة بشأن جميع تلك الوقائع المنسوبة إلى الوزير.
وكشف لـ "المصريون" أن هناك المزيد من الخطوات التي سيتم اتخاذها وتستهدف تكثيف الضغوط على مرعي لإجباره على تقديم استقالته أو دفع الجهات المسئولة لإقالته، معتبرًا البلاغ الخطوة الأولى في هذا الإطار.
