حدد المستشار السيد عبد العزيز عمر رئيس محكمة استئناف القاهرة جلسة الأحد القادم لبدء أولى جلسات محاكمة وزير الإسكان السابق أحمد المغربي ووزير السياحة السابق زهير جرانة أمام محكمة جنايات القاهرة برئاسة المستشار عادل عبد السلام جمعة، بتهم التربح وتمكين الغير من منافع مالية والإضرار العمد بالمال العام.
كما حدد جلسة الثامن من مارس المقبل لبدء أولى جلسات محاكمة وزير التجارة والصناعة السابق رشيد محمد رشيد، ورجل الأعمال أحمد عز أمين التنظيم بالحزب "الوطني" سابقا ورجل الأعمال عمرو عسل، أمام محكمة جنايات القاهرة برئاسة المستشار محمد فتحي صادق.
ونسبت النيابة إلى المغربي قيامه بصفته وزيرا للاسكان بإبرام عقد بيع لقطعة أرض مساحتها 113 فدانا مملوكة للدولة بمحافظة 6 أكتوبر إلى شركة "أخبار اليوم" للاستثمار، بالمخالفة للقواعد المقررة قانونا التي تحظر التصرف في الأراضي المخصصة من وزارة الإسكان قبل سداد ثمنها أو إقامة المشروع المحدد في التخصيص.
وقالت إن المغربي فعل ذلك ليمكن الشركة المشترية من تغطية تصرفها ببيع هذه القطعة الذي سبق هذا التعاقد إلى شركة أخرى استحوذت عليها شركة (بالم هيلز) للتعمير التي يساهم فيها المغربي مما حقق له وللشركة المشترية ربحا يفوق مبلغ 159 مليون جنيه، وأضر بأموال الدولة بمبلغ يزيد على 272 مليون جنيه يمثل الفارق بين سعر الأرض وقت استحقاق استردادها لعدم سداد كامل قيمتها للدولة وبين ما سددته شركة أخبار اليوم ثمنا لها.
كما تقدم الدكتور سيد بحيرى المحامى بدعوى قضائية ضد وزير الإسكان السابق ومدير عام الشئون التجارية والعقارية ورئيس جهاز مدينة القاهرة الجديدة لبيعهم قطعة أرض بالتجمع الخامس لثلاثة أشخاص مختلفين.
وقالت الدعوى إن مهندس رمضان السيد محمد موسى تقدم لمركز خدمات المجتمع بالتجمع الخامس لحجز قطعة ارض وبالفعل حجز قطعة أرض رقم 53 ولم تخصص له بعد ذلك واكتشف انه تم تم بيع هذه الارض لثلاثة اشخاص فى وقت واحد.
ونسبت النيابة أيضا إلى زهير جرانة وزير السياحة السابق قيامه بمنح تراخيص إنشاء شركات سياحية أو تعديل فئاتها إلى الفئة الأعلى للعديد من الأشخاص الذين يرتبطون معه بعلاقات شخصية.
وقالت إن جرانة ساعد هؤلاء الأشخاص المرتبطين به بعلاقات شخصية على مباشرة النشاط السياحي بغير حق، ومكنهم من جني أرباح طائلة على خلاف القرارات الوزارية الصادرة بوقف منح هذه التراخيص، كما أنه قد رفض منحها لآخرين وأنه انفرد بإصدار هذه التراخيص أو رفع فئاتها دون أية معايير محددة لأشخاص تربطهم به علاقات شخصية، بغية تمكينهم من تحقيق منافع مالية.
فيما نسبت النيابة إلى رشيد محمد رشيد وزير التجارة والصناعة السابق وعمرو محمد عسل رئيس الهيئة العامة للتنمية الصناعية الاتفاق مع رجل الأعمال أحمد عز على إصدار موافقة على الترخيص بإنتاج الحديد الاسفنجي والبيليت بالمجان للشركات المملوكة لعز.
وأشارت إلى أن هذه الموافقة جاءت بالمخالفة للقرارات الوزارية التي تقضي بأن يكون منح هذه التراخيص بالمزايدة العلانية بين الشركات، فضلا عن قيام عمرو عسل أيضا بالترخيص لعز بإقامة مصنعين بالمنطقة الحرة بالسويس، وذلك بالمخالفة للشروط التي تنص على عدم جواز منح أكثر من ترخيص لذات المستثمر، الأمر الذي ألحق ضررا جسيما بالمال العام قيمته 660 مليون جنيه.
من جانب آخر، استمعت نيابة الأموال العامة العليا الاثنين إلى أقوال عدد كبير من الشهود من المسئولين باتحاد الإذاعة والتلفزيون بقطاعات التسويق والحسابات والانتاج، وكذلك بعض رؤساء القنوات الإقليمية وذلك بشأن المخالفات المالية الإدارية بالاتحاد، والمنسوب ارتكابها إلى كل من أنس الفقي وزير الإعلام السابق، وأسامة الشيخ رئيس اتحاد الإذاعة والتلفزيون السابق، والمحبوسين حاليا بصورة احتياطية على ذمة التحقيقات، بتهمة التربح لنفسيهما وللغير وتسهيل الاستيلاء على المال العام.
وقامت النيابة خلال التحقيقات، التي جرت بإشراف المستشار علي الهواري المحامي العام الأول للنيابة، بسؤال الفقي والشيخ بشأن المبالغ الباهظة التي تم إنفاقها على تطوير البرامج والمكافآت والأجور المبالغ فيها للمذيعين والضيوف، وتوضيح السند القانوني في تحديدها والمسئول عن ذلك.
كما قامت بسؤالهما بشأن البنود المتكررة في ميزانية الاتحاد، والتي أشارت تحريات الجهات الرقابية إلى أن الغرض منها كان يتمثل في إخفاء وجود عجز في الميزانية.
وتم أيضا سؤالهما بشأن الانتاج المشترك للمسلسلات بالاشتراك مع بعض الشركات الخاصة وما تم من شراء الاتحاد لحق عرض تلك المسلسلات (على التلفزيون المصري) بمبالغ ترواحت ما بين 20 إلى 30 مليون جنيه لكل منها، على الرغم من أن الاتحاد شارك بنسبة كبيرة في انتاجها، إلى جانب أن العقود السابق إصدارها قبل تولي الشيخ لرئاسة الاتحاد كانت تنص على حق التلفزيون المصري في عرضها بالمجان ودون سداد أية مقابل مادي.
وقامت النيابة بسؤال الفقي والشيخ والتلفزيون السابق بشأن ما تم من إنفاق لملايين الجنيهات من أموال الاتحاد على الدعاية الانتخابية في الانتخابات الرئاسية وكذلك انتخابات مجلسي الشعب والشورى، لبيان مدى اتفاقها مع ما نصت عليه أحكام قانون مباشرة الحقوق السياسية وقرارات اللجنة العليا للانتخابات من المساواة بين المرشحين جميعا دون أدنى تفرقة.
من جهة أخرى، استمعت نيابة الأموال العامة العليا بإشراف المستشار عماد عبد الله المحامي العام للنيابة إلى أقوال عدد من المسئولين بالهيئة العامة للمجتمعات العمرانية الجديدة بشأن شهادتهم حول قرارات التخصيص التي صدرت لمجموعة من رجال الأعمال بتخصيص مساحات من أراضي الدولة لهم بالأمر المباشر، دون إجراء مزايدات إعمالا لأحكام القانون والذين كان من بينهم على سبيل المثال لا الحصر رجل الأعمال المغربي الجنسية فيصل الشعبي، ورجل الأعمال الإماراتي عمر الفطيم، وكذلك رجل الأعمال سليمان عامر مالك مشروع جولف السليمانية، والشركة العقارية المملوكة لرجل الأعمال مجدي راسخ.
كما استمعت النيابة أيضا إلى أقوال مسئولي هيئة التنمية الزراعية حول شهادتهم بشأن قيام بعض أصحاب الأراضي بطريق القاهرة/الإسكندرية الصحراوي بتحويل الأراضي الزراعية المملوكة لهم إلى أراض سكنية دون تصريح لهم بذلك، ودون سداد الغرامات المستحقة، وأيضا السؤال عما اتخذته الهيئة من إجراءات بهذا الشأن.
